Can I Buy My Freehold?

If you fulfil certain statutory criteria, you are legally entitled to compel your landlord to sell you the freehold of your building. The requirements which must be fulfilled are…

  1. You are the owner of a long lease (one originally granted for at least 21 years)
  2. There are at least two flats in your building
  3. At least 50% of qualifying tenants agree to participate in the process
  4. No more than 25% of the internal floor area is used for non-residential purposes

If you meet these criteria then you will probably be able to purchase your share of freehold through the leasehold enfranchisement process. However there are some exemptions:

  • Charitable housing trust landlords
  • Resident landlords in properties of four units or fewer
